These Terms & Conditions (“Terms”) are a binding agreement between you and Community Gigs (“Community Gigs”, “we”, “us”, “our”) governing your use of our website and mobile app (the “Service”). By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Community Gigs is a community marketplace that helps neighbors find and offer local help — odd jobs, home repair, cleaning, tutoring, pet care, and more. We provide the platform: listings, profiles, applications, messaging, reviews, and tools to create written agreements (including independent contractor agreements) between users.
We are not a party to your gigs. Community Gigs is not an employer, agent, broker, or insurer of any user. We do not perform, supervise, guarantee, or pay for any work. All gigs are agreements between you and the other user, and you are solely responsible for negotiating, performing, and paying for work, and for complying with all applicable laws (including tax, licensing, and labor laws).
You may not use the Service to:
We may remove content, cancel listings, or suspend accounts that violate these rules, at our discretion and without notice.
You keep ownership of the content you post (listings, photos, messages, reviews, profiles). You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content as needed to operate the Service (for example, showing your listing to other users). This license ends when you delete the content, except for copies retained in backups or where required for legal compliance.
You promise you have the rights to everything you post, and that your content does not infringe anyone else's rights or violate the law.
Meet people you don't know in public places when possible, tell someone where you are, verify claims and credentials (licenses, references) before hiring, and trust your instincts. Use the in-app report feature to flag suspicious listings or behavior. We screen for abuse where we can, but we cannot verify every user's identity or the accuracy of every listing, and we are not responsible for the conduct of users.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION POSTED BY USERS IS ACCURATE, COMPLETE, OR HARMLESS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL LIABILITY FOR GIGS, AGREEMENTS, TRANSACTIONS, AND INTERACTIONS BETWEEN USERS.
To the maximum extent permitted by law, Community Gigs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability for all claims related to the Service is limited to the greater of $100 or the amount you paid us in the twelve months before the claim (currently $0, as the Service has no fees). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to defend, indemnify, and hold harmless Community Gigs and its operators from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your conduct, your breach of these Terms, or your gigs, agreements, and transactions with other users.
You may stop using the Service and delete your account at any time. We may suspend or terminate your account or access at any time and for any reason, including suspected violations of these Terms or suspected unlawful activity. Sections that should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms are governed by the laws of the United States and the state in which the Community Gigs operator is based, without regard to conflict-of-law rules. Any dispute arising from these Terms or the Service will first be raised with us so we can try to resolve it informally within 30 days. If we cannot resolve it, it will be resolved in the courts of that state or, for smaller claims, in small-claims court where you live. Claims must be brought individually — not as a plaintiff or class member in a class or representative proceeding.
We may update these Terms from time to time. If we make material changes, we will notify you by email or in the app before the change takes effect, and update the “Last updated” date above. Continuing to use the Service after changes take effect means you accept the updated Terms. If you do not accept a change, you may stop using the Service.
